The Stuttgarter’s Klima Community is an exchange platform for the Climate Protection community - a digital network and toolkit to facilitate implementation of Climate Solutions. To provide our services effectively and improve your experience, we collect and use your personal data. As a responsible entity, we are strongly committed to protecting your privacy.
By using our Services and/or creating an account with us, you agree to our Terms and Conditions and to the collection and use of information in accordance with this Privacy Notice.

The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
For the purposes of this Privacy Notice:
- Account means a unique account created for you to access our Service or parts of our Service.
- Organisation (referred to as either “organisation”, "we", "us" or "our" in this Agreement) refers to Klima Community Stuttgart e.V., Amtsgericht Stuttgart.
- Provider refers to BABLE GmbH who is responsible for the development and technical maintenance of the platform.

- Service refers to the Website, Tools, Applications, Newsletter and any other service offered by the Company.
- Third-party Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- Website refers to Klima Community Stuttgart, accessible from http://www.klima-community.de.

2. What data do we collect?
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. If you are 16 years of age or younger, you need permission from a legal guardian to be part of our community.

Usage Data is collected automatically when using the Service. This includes: information such as your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, device type, ID for listing, geo-location information and other diagnostic data.
Mobile Device: When you access the Service by or through a mobile Device, we collect certain information automatically. This includes, but is not limited to: the type of mobile device you use, your mobile device unique ID, geo-location information, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
Browser Data: We also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device. This includes: computer and connection information such as statistics on your page views, traffic to and from the sites, referral URL, ad data, and your IP address.
2.3 Embedding Videos and other content
If you provide us with access to any site with video content, then you agree that we may share your video with, or obtain information about your video from third-party social media sites for at least two years or until you withdraw consent. You control the personal information you allow us to have access to through the privacy settings on the applicable social media site and the permissions you give us when you grant us access to your personal information retained by the respective social media site about you.

- To enable, facilitate and streamline the functioning of and your access to the Platform.
- To better understand how you navigate through and interact with the Klima Community Platform and to improve the Platform accordingly.

- To monitor and analyse the performance, operation, and effectiveness of the Platform and its advertisements.
- To enforce legal agreements that govern use of the Platform.
- For fraud detection and prevention, and investigations.
- For purposes of our own user support, analytics, research, product development, and regulatory compliance.
Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyse Our Service. The technologies we use include:

3. How do we use your data?
We use the personal information we collect to:
- To provide and maintain our Service, by monitoring the usage of our Service.
- To manage your Account and requests: to manage your registration as a user of the Service. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered user. It is also used to manage and attend to your requests to us.
- To provide you with personalised advertising and marketing content such as news, special offers and general information about other goods, services and events which we offer that are similar to those that you already use or have enquired about.
- To send you our information mailings, such as our newsletter. As highlighted in our Terms and Conditions, once you sign up for our platform, we automatically add you to our mailing list, which is sent via Mailchimp. You can unsubscribe at any time. Only your first name, last name, employer and e-mail address are sent to Mailchimp.
- To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services. Also, to notify you regarding your account, to troubleshoot problems with your account, to resolve a technical problem, to poll your opinions through surveys or questionnaires, or as otherwise necessary to provide you with customer service
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services you have used or of any other contract with us through the Service.
- For other purposes: we may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
4. Who do we share your data with?
We may disclose your personal information to employees of the Organisation, the provider or to Third Party Service Providers. We do this to provide you access to our Services; to comply with our legal obligations; to enforce our Terms and Conditions; to facilitate our marketing and advertising activities; to prevent, detect, mitigate or to investigate fraudulent or illegal activities related to our Service. 4.1 Technology Provider
BABLE GmbH, as technology provider and responsible company for developing, hosting and maintaining the Platform, has access to all data on the platform with the main purpose of ensuring effective functioning of the platform. The data is essential to maintain the Services in operation and constant improvement.
DPS: as technology provider and responsible company for developing, hosting and maintaining tools of the platform, such as the Antragsassistent, has access to all data on the platform with the main purpose of ensuring effective functioning of the tool. The data is essential to maintain the Services in operation and constant improvement.
4.2 Service Providers and financial institutions partners
Third party service providers may also be provided with your Personal Data. These are organisations who help us to provide our Service and assist us in providing customised advertising. These are also organisations who assist us with the prevention, detection, mitigation and investigation of potentially illegal acts as well as with violations of our Terms and Conditions, fraud and/or security breaches, bill collection, affiliate and rewards programs, co-branded credit cards and other business operations.

4.3 Law enforcement, legal proceedings, and as authorized by law
We may release your Data:
- to comply with our legal requirements, enforce our Terms and Conditions, respond to claims that a listing or other content violates the rights of others or protect anyone's rights, property or safety.
- to law enforcement or governmental agencies, or authorized third-parties, in response to a verified request relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our users to legal liability. We will only disclose information we deem relevant to the investigation or inquiry, such as name, city, state, postcode, telephone number, email address, User ID history, IP address, fraud complaints, or bidding and listing history.
- to third parties involved in a legal proceeding, if they provide us with a subpoena, court order or substantially similar legal procedure, or we otherwise believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.
4.4 Change of Ownership
If we were to merge with, be acquired by an organisation, have a change in our ownership structure, type legal entity or settle legally in a different country, we may share information with the involved stakeholders in accordance with our global privacy standards. Should such an event occur, we will require that the new (combined) entity follow this Privacy Notice with respect to your personal information. If your personal information is collected, used, disclosed, or retained for any purposes not covered in this Privacy Notice, you will receive prior notification of the processing of your personal information for the new purposes.
5. How do we store Your data?
We store your personal data in secure and dedicated servers in Germany.
In addition, your data is stored in the servers of our Service Providers including but not limited to: MailChimp, Hubspot, Microsoft, BABLE, DPS and NetzDesign.
6. How long do we keep your data?
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods. Log files are stored for a period of two weeks, whereas google analytics stores usage data for a period of 14 months.
After it is no longer necessary for us to retain your personal information, we dispose of it in a secure manner.
Once you make a public posting, you may not be able to change or remove it. Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable national laws.
7. How is your data secured?
The security of your Personal Data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
We protect your information using technical and administrative security measures to reduce the risks of loss, misuse, unauthorised access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centre, and information access authorisation controls. If you believe your account has been abused, please contact us following the instructions in the Contact Us section.
In case of a possible leak of data, our data processor and site administrator will notify us immediately after discovering or becoming aware of any such incident. Following the report of the incident, we will carry out an assessment with our contractors and partners to identify corresponding measures We will inform you about the situation, the gravity of the situation and the solution as soon as possible.
8. What are your data protection rights?
Our Organisation would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:
- The right to access – You have the right to make a request for copies of your personal data. We may charge you a small fee for this service.
